Uttar Pradesh is also planning to introduce a law on online gaming and the draft bill for the same has been presented but is yet to be approved. The law commission of the state has already prepared a draft bill that penalizes any act of gambling, including online gambling and various forms of wagering with up to 3 years of imprisonment and they are also non-bailable offenses.

Punishment for Illegal Online Gambling in India

In the Public Gambling Act, 1867, no provisions were provided regarding online-based gambling whereas there is another Act, Information Technology Act, 2000, that identifies web-based wagering and gaming but it does not mention online gambling. As mentioned above, gambling is a State subject; therefore, states make their own laws for the same. In this context, it’s important to note that even in states where online gambling is permitted, certain restrictions and regulations may apply.

  • The Payment and Settlement Act of 2008 authorised the Reserve Bank of India to run or launch a system of payments for controlling the use of electronic payments of all types in India, primarily for regulating and limiting online gambling in that country.

The Supreme Court on Tuesday deferred hearing on petitions filed by gaming companies challenging the law that banned money gaming to November.

Constitutional framework

In Goa and Sikkim, only five-star hotels can obtain casino licenses approved by the state, while Goa also permits offshore casino operations on ships along the Mandovi River. Currently, Sikkim has two licensed casinos—Casino Sikkim and Casino Mahjong—while Goa hosts ten, including six land-based and four floating casinos. The outcome of gambling could also be long-term for example a future sports contest. The age-old traditional gambling can be understood in the context of brick and mortar format that is in physical space, whereas, modern gambling consists of computers, mobile phones, the internet et cetera.

The distinction between the two types of competitions is as clear-cut as the difference between commercial and wagering contracts. While it may sometimes be difficult to decide, based on the facts, which category a particular competition belongs to, once its true character is determined, it must fall squarely into one category or the other. The rapid growth of the Indian online gaming industry highlights the urgent need for unified regulations and a central regulatory authority.

Are real money games legal in India?

Most Indian states permit real money or stakes-based online gaming. As a result, it is not outlawed unless the state government so declares.

The GST Council has formed a committee for considering a common tax regime for online gaming. It seeks to remove differences between games of skill and that of chance from a taxation point of view. Ironically, lotteries which are entire games of chance are permitted in many states, albeit strictly regulated and looked upon by law and courts as a disastrous ‘evil’. In terms of the Lotteries (Regulation) Act, 1998, which is the lottery law in India states may organize, conduct or promote lotteries subject to prescribed conditions.

According to this Act, all forms of gambling and betting activities, except for horse racing are illegal. Moreover, PGA only deals with physical betting and is silent on the online betting. This Act continues to remain in force even after independence, having been preserved under Article 372 of the Constitution of India.

Similar petitions were also filed before the Karnataka and Delhi high courts, including one by Bagheera Carrom OPC Pvt. In September, the Madhya Pradesh High Court rejected an appeal by Clubboom11 Sports & Entertainment Pvt. Ltd, a Gwalior-based gaming firm, seeking a stay on the government’s notification of the law. In those hearings, solicitor general Tushar Mehta told the court that the legal issues and precedents cited before the high courts had already been extensively argued before Justice Pardiwala’s bench in the 28% GST case on online gaming, where the order is pending.

Sikkim is so far the only state in India that has enacted a statute pertaining to online gaming i.e. The lottery is not illegal in India as each state determines whether or not to legalize lotteries. 13 Indian states have legalized the lottery including Assam, Arunachal Pradesh, Goa, Kerala, Madhya Pradesh, Maharashtra, Manipur, Meghalaya, Mizoram, Nagaland, Punjab, Sikkim, and West Bengal.

Even though the basics of gambling remain the same, many people who love the glitz of casinos or the excitement of crowds cheering at sporting events discover that when they gamble online, they miss out on these experiences. The government has to regulate all forms of gambling, including online gambling. Given the enormous expansion of the internet gambling sector, the Constitution should be amended to incorporate regulation of online gambling in the Union List, thus permitting the adoption of centrally administered online gambling laws. Betting on horse races has been judicially recognised as a game of skill and most State Gaming Laws specifically exclude it from their prohibitions subject to certain conditions. There is no specific regulator or statutory language for most State Gaming Laws that govern online betting on horse races since most statutes are pre-internet in context. However, the horse race may have some conditions imposed by the race club organising aviator signal the horse race.
